RWRA Membership Terms & Conditions

These Terms & Conditions govern membership of the Rivonia Wide Residents Association (RWRA), a voluntary Public Benefit Organisation, Number 930085417 and Non-Profit Company, Registration Number 2024/533175/08, operating within the geographic area of Ward 106, including the suburbs of Edenburg, Rivonia and parts of Woodmead, Johannesburg, Gauteng, South Africa.


1. Membership Eligibility

1.1 Membership is open to the following persons within the geographic boundaries of the voting district of Rivonia as designated by the Demarcation Board of South Africa:

1.2 Applicants must provide accurate, complete, and up-to-date information when applying for membership and agree to notify the RWRA of any material changes.

1.3 The RWRA reserves the right to approve or decline membership applications at its sole discretion, acting reasonably and in the interests of the community.


2. Types of Membership

There are three categories of membership: Ordinary, Active, and Associate.

2.1 Ordinary Membership

2.1.1 Ordinary membership is open to any person who is a registered adult resident (based on a verifiable residential address) or property owner who pays rates and taxes to the city.

2.1.2 Residents become ordinary members by registering their details on the RWRA's official website and accepting these terms and conditions.

2.1.3 Ordinary members will be informed about RWRA activities and developments affecting residents of Rivonia.

2.1.4 Ordinary members have the right to access general information and to be kept informed about the RWRA's activities by means of the website, emails, social media, and any other written or electronic means.

2.2 Active Membership

2.2.1 Active membership with voting rights is open to any ordinary adult resident, subject to Board of Directors approval, where:

2.2.2 An application to upgrade from ordinary to active volunteer membership may be made to the Membership Secretary.

2.2.3 The Membership Secretary shall keep a register containing the names, physical and email addresses, and contact numbers of all members. It is the duty of members to notify the Secretary of their contact details and any subsequent changes.

2.2.4 The Board of Directors has the right to refuse an application for active membership and may also revoke active membership if a member has been found to act against the best interests of the community or to have abused their membership for personal gain. Members may appeal as set out in clause 10.

2.2.5 Active members have the right to vote at RWRA meetings, including the AGM and SGM, or when an electronic vote is required, whether as an individual or as a representative of a household.

2.2.6 Active members have the right to be consulted before significant policy or strategic decisions are made by the Board of Directors.

2.2.7 Active members will be given at least two weeks' notice of the AGM and invited to attend. At the AGM, active members exercise their right to determine RWRA policy.

2.2.8 Active members choosing not to attend the AGM and not sending apologies may be removed as Active Members and relegated to Ordinary Membership.

2.2.9 Active memberships are valid within the financial year of contribution.

2.3 Associate Membership

2.3.1 Associate membership (without voting rights) is open to adult non-residents and any commercial, voluntary association, non-profit organisation, body corporate, or home-owners association located in Rivonia, subject to Board approval, where:

2.3.2 Associate members do not have the right to vote at RWRA meetings but may attend and express their views at AGMs and SGMs.

2.3.3 Associate members have the right to be advised of significant policy or strategic decisions made by the Board of Directors.

2.3.4 Applications for Associate membership must be made through the Membership Secretary.


3. Active & Associate Membership Donations

3.1 Membership donations, where applicable, are set annually by the RWRA Executive Committee and approved in accordance with RWRA's constitution and PBO status.

3.2 Annual donations received between 1 March and 31 December are allocated to the current year. Payments received from 1 January to end of February are allocated as an "early bird donation" to the following year.

3.3 Donations received between 1 March and end of February are eligible for a Section 18A tax-deductible certificate, subject to the correct information being supplied to the RWRA financial administrators.

3.4 Membership donations are payable in advance and are non-refundable unless otherwise determined by the RWRA directors.

3.5 If the Annual Active Membership Donation is not received in any one year, membership will revert to Ordinary membership.


4. Special Project Donations

4.1 Donations received for special projects between 1 March and end of February are eligible for a Section 18A tax-deductible certificate, subject to the correct information being supplied to the RWRA financial administrators.

6. Privacy, Data Protection & POPIA Compliance

6.1 The RWRA collects and processes personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

6.2 Personal information may include names, contact details, property addresses, and communication preferences.

6.3 Personal information is collected solely for legitimate RWRA purposes, including:

6.4 The RWRA will take reasonable technical and organisational measures to safeguard personal information against loss, misuse, unauthorised access, or disclosure.

6.5 Personal information will not be shared with third parties without consent, except where required by law or necessary for legitimate RWRA operations (e.g. security providers, communication platforms), subject to appropriate safeguards.

6.6 Members have the right to request access to, correction of, and deletion of their personal information upon relocation or departure from Rivonia, subject to legal and operational requirements.

6.7 Members agree not to harvest any other member's names or contact numbers for personal use, group creation, or to market and promote services. Any member found to be doing so will have legal action taken against them.


7. Communication & Use of Digital Platforms

7.1 The RWRA uses digital platforms including email, messaging services (e.g. WhatsApp), websites, and social media to communicate with members.

7.2 Members participating in RWRA-managed digital or social platforms agree to:

7.3 The RWRA reserves the right to moderate, restrict, or remove content and participants from its platforms to maintain constructive engagement.

7.4 Views expressed by members on RWRA platforms do not necessarily reflect the views of the RWRA, its Directors, Executives, or Committee Members.


8. Code of Conduct

8.1 Members must treat fellow members, committee members, service providers, and public officials with respect.

8.2 Abusive, threatening, discriminatory, or unlawful conduct โ€” whether in person or online โ€” will not be tolerated.

8.3 Breaches of the Code of Conduct may result in warnings, suspension, or termination of membership.


9. Limitation of Liability & Indemnity

9.1 The RWRA is a voluntary association and does not provide guarantees regarding safety, security, service delivery, or outcomes of community initiatives.

9.2 Members participate in RWRA activities, meetings, and initiatives at their own risk.

9.3 To the extent permitted by law, the RWRA, its committee members, and volunteers shall not be liable for any loss, damage, injury, or expense arising from participation in RWRA activities.

9.4 Members indemnify the RWRA, its Directors, Executives, and Committee Members against claims arising from their own unlawful, negligent, or unauthorised actions.


10. Revocation & Suspension of Membership

10.1 Membership may be terminated by a member at any time by providing written notice. Donations already paid will be forfeited.

10.2 The RWRA may suspend or terminate membership where a member:

10.3 Termination decisions will be made fairly and members may be afforded an opportunity to make representations. A terminated member may, within one month of being informed of the decision, appeal to a SGM called in that year. The decision at the SGM shall be determined by a majority of 60% of active members present in person, by proxy, and/or electronic means. If expelled, the member shall cease to be a member and their name shall be removed from the register.


11. Amendments

11.1 The RWRA Directors reserve the right to amend these Terms & Conditions from time to time.

11.2 Members will be notified of material changes via reasonable communication channels. Continued membership constitutes acceptance of amended terms.


12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.


By accepting membership, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.
